The speeding ticket which left a nasty smell
Lawtons Solicitors are delighted to have been asked to prepare a series of articles for the Bedfordshire Business Monthly. The articles will deal with Road Traffic Law. Our lawyers who will prepare the series of articles, Alan Jones and Stephen Halloran, hope you find this and the forthcoming articles of interest.
A Summons for Speeding is something no one wants but, due to the number of speed cameras, the chances of this happening have greatly increased. The Summons can result in Penalty Points (or even a disqualification for the offence) on your licence and those Points can eventually result in disqualification. The effects of this can be devastating if your occupation requires you to have your licence or you are required to drive during the course of your employment.
The thought then of receiving a Summons and the resulting Points from a faulty speed camera or one that has not been properly calibrated must be particularly irritating. But this is the situation that occurred recently on a stretch of the Lower Luton Road.
It has been accepted by the authorities that this has been the case and letters have been sent to all those who have been the unfortunate victim of this. This will result in the money being returned for the fines and /or costs imposed and, if the follow-up letter is sent to the DVLA, the points being removed from the driving licence.
This incident serves to remind us all that technology is not infallible. It also provides food for thought for those who may have received a Summons or an Offer of a Fixed Penalty Notice. Early Legal advice can, in the appropriate circumstances, assist in identifying any potential defences or deficiencies in the process. Not all cases will result in the ‘magic bullet’ by the discovery of a faulty camera, but with the implication of points clear to everyone the necessity for obtaining specialist Legal advice is overwhelming.
As Lawtons Solicitors we provide specialist advice in all aspects of this specialist area of law. The advice we provide is from locally qualified Solicitors and we endeavour to deal with your cases in a common sense manner.
