Drugs - The Law
This leaflet will, we hope, provide a very
basic level of knowledge of the legal position on Drugs. Due to the complexity
of this area of law we would advice that you, or a family member on your
behalf, seek prompt and effective legal advice. This will ensure that a more
considered and detailed level of analysis can be provided for a particular
case.
The Misuse of Drugs Act is the starting
point for drugs law. It divides drugs into categories and each category is then
treated differently by the Courts. The categories (or Classes), and main drugs
which are included are as follows:
- Category
A (include) – Heroin, Cocaine, Estacy
- Category
B (include) – Cannabis, Amphetamine (Speed)
- Category
C (include) – Diazepam, Tranqillisers, GHB
Offences involving Class A drugs are much
more serious and attract far higher penalties than, say, Class C. Also
penalties the Courts’ impose depend upon the type of charge that follows;

with intent to supply
The type of charge that could follow for
anyone arrested will depend upon the evidence gained during the Police enquiry
and the account given by someone during the course of interview at the Police
Station would be used to assist in decision making.
As such, it is vitally important that early
professional assistance is sought. The consequences of not seeking early help
could be catastrophic. Police Station advice and assistance for Drugs related
matters is free and you will be able to see someone at the Police Station and
have them present during interview. Don’t think it is not serious, it is.
